Terms and conditions

In these general terms and conditions, the following terms are used in the following meaning, unless expressly stated otherwise. - Offer: any offer or quotation to the Client to provide Services by VindTaxi. - Company: the natural or legal person acting in the exercise of a profession or business. - Consumer: the natural person who does not act in the exercise of a profession or business. - Driver: the service provider of VindTaxi who offers Services to the Client. - Services: the services that VindTaxi offers, including passenger transport, airport transport, business transport and related activities. - Assignment: any agreement whereby VindTaxi provides transport or driver services for the Client. - Client: the Company or Consumer who has appointed VindTaxi to perform Services. - Agreement: any agreement between the Client and VindTaxi to which these general terms and conditions apply. - Traveler: the natural person who is actually transported by VindTaxi.

• These general terms and conditions apply to every offer from VindTaxi, every agreement and all services offered by VindTaxi. - Deviations from these general terms and conditions are only valid if agreed in writing. - General terms and conditions of the Client are expressly excluded. - If one or more provisions of these terms and conditions prove to be invalid, the remaining provisions will remain in full force and effect.

• All offers from VindTaxi are without obligation unless stated otherwise in writing. - An agreement is only concluded after VindTaxi has confirmed a reservation or order. - Obvious errors or mistakes in quotations or offers do not bind VindTaxi.

• The agreement is concluded as soon as the Client agrees to an offer of VindTaxi. - VindTaxi reserves the right to refuse orders without giving reasons. - If several persons enter into an agreement jointly, they are jointly and severally liable.

• The agreement is entered into for the duration of the agreed services. - Both parties can terminate the agreement if the other party fails to fulfill its obligations. - VindTaxi may refuse or terminate a ride in the event of aggressive, dangerous or inappropriate behavior by the Traveler.

• VindTaxi provides its services carefully and professionally. - Specified times are indicative and depend on traffic situations and force majeure. - VindTaxi may engage third parties to perform services.

• VindTaxi uses own vehicles unless otherwise agreed. - VindTaxi ensures that you are present at the agreed location on time. - Free cancellation is possible up to 24 hours before the start of the ride, unless otherwise agreed. - If you cancel within 24 hours, costs may be charged.

• Client must provide correct and complete information. - Any changes must be communicated in a timely manner. - Client is responsible for correct contact and journey details.

• Traveler must follow the driver's instructions. - Traveler is required to wear a seat belt.

It is forbidden to: - to smoke in the vehicle; - use alcohol or drugs without permission; - cause damage or pollution; - exhibit aggressive or disruptive behavior.

Damage caused by the Traveler can be recovered from the Traveler or Client.

• Changes to the ride or service may incur additional costs. - Additional work will be carried out at the applicable rate.

• All prices include VAT unless stated otherwise. - Invoices must be paid within the stated payment term. - If payment is not made on time, statutory interest is due. - VindTaxi reserves the right to require advance payment.

• If payment is not made, the Client will first receive a reminder. - Afterwards, collection costs and statutory interest may be charged. - All judicial and extrajudicial costs will be borne by the Client.

• VindTaxi processes personal data in accordance with the GDPR. - Personal data will only be used for services and administration. - More information can be found in the privacy policy on the VindTaxi website.

• VindTaxi may suspend services in the event of non-payment. - Work already carried out remains affordable. - Suspension does not give the right to compensation.

VindTaxi is not liable for delays or cancellations due to force majeure.

Force majeure includes, among other things: - traffic jams; - extreme weather; - malfunctions; - government measures; - illness; - technical defects.

• VindTaxi is only liable for direct damage caused by intent or gross negligence. - Liability is limited to the invoice amount of the relevant journey or assignment.

VindTaxi is not liable for: - indirect damage; - consequential damage; - missed flights; - loss of income; - loss of luggage or personal belongings.

• Both parties treat confidential information as strictly confidential. - Information is not shared with third parties unless required by law.

• The Client guarantees the accuracy of the information provided. - The Client indemnifies VindTaxi against claims from third parties arising from incorrect data.

• Complaints must be reported in writing within 7 days after the ride via info@vindtaxi.com. - VindTaxi will handle complaints as soon as possible. - The parties will try to find a solution together.

• Dutch law applies to all agreements. - Disputes will be submitted to the competent judge of court Rotterdam, location Rotterdam. - If a provision proves to be invalid, the other provisions remain in force.
